Court Fees Payable in the Category Of the Cases in the Bombay High Court (HIGH COURT PRACTICE 4)


Court fees payable in proceedings before the High Court in the State of Maharashtra are governed by the Maharashtra Court Fees Act, 1959. This statute regulates the fees to be paid in courts and public offices in Maharashtra and is applicable to matters filed before the Bombay High Court.


Proper understanding of court fee provisions is essential for advocates, as incorrect payment of court fees may result in office objections, delay in registration, or rejection of filings.



SCHEME OF THE ACT

The Act consists of 52 sections divided into seven chapters and Schedules..

1. Chapter I – Preliminary (Ss 1-2)

2. Chapter II – Fees in the High Court and in the Small Causes court at Bombay (Ss 3-4)

3. Chapters III – Computation of Fees (Ss 5-20)

    Section 6 provides computations of Court fees payable in certain suits.

4. Chapter IV – Probates, Letter of Administration and Certificates of Administration (Ss 21-31)

5. Chapter V – Process Fees (Ss 32-35)

6. Chapter VI – Of the mode of levying fees (Ss 36-42)

7. Chapter VII – Miscellaneous (Ss 43-52)

YPES OF COURT FEES –

Under the Maharashtra Court Fees Act, 1959, court fees are broadly classified into the following two categories:

1. Ad Valorem Court Fees

Ad valorem means “according to the value.” Ad valorem court fees are calculated as a percentage of the valuation of the subject matter involved in the case. These fees are applicable in matters where the relief claimed is capable of monetary valuation.

Schedule I of the Maharashtra Court Fees Act prescribes the ad valorem court fees payable in various categories of cases.

 

2. Fixed or Specific Court Fees

In certain proceedings, court fees are fixed in amount, irrespective of the valuation of the subject matter. Such fees are payable in matters where valuation is either not required or is statutorily fixed.

Schedule II of the Maharashtra Court Fees Act prescribes the fixed or specific court fees payable in such cases.
