Court Fees Payable in the Category Of the Cases in the Bombay High Court (HIGH COURT PRACTICE 4)


The Maharashtra Court Fees Act 1959 is law relating to fees taken in the courts and public offices in the state of Maharashtra.

SCHEME OF THE ACT

The Act consists of 52 sections divided into seven chapters and Schedules..

1. Chapter I – Preliminary (Ss 1-2)

2. Chapter II – Fees in the High Court and in the Small Causes court at Bombay (Ss 3-4)

3. Chapters III – Computation of Fees (Ss 5-20)

    Section 6 provides computations of Court fees payable in certain suits.

4. Chapter IV – Probates, Letter of Administration and Certificates of Administration (Ss 21-31)

5. Chapter V – Process Fees (Ss 32-35)

6. Chapter VI – Of the mode of levying fees (Ss 36-42)

7. Chapter VII – Miscellaneous (Ss 43-52)


TYPES OF COURT FEES –

There are two kinds of Court Fees under the Court Fees Act -

1. Ad Valorem Court fees -

it means according to the valuation. Ad valorem duties are always estimated at a certain per cent, on the valuation of the property as opposed to fixed or specific duties. Schedule 1 of the Maharashtra Court Fees Act provides Ad Valorem Court Fees payables in the Category of cases.

2. Fixed or specific court fees -

The court fees on certain cases and proceedings are fixed irrespective of valuation.

Schedule 2 of the Maharashtra Court Fees Act provides Fixed Court Fees payables in the Category of cases.

COURT FEES PAYABLE IN THE CATEGORY OF THE CASES IN THE BOMBAY HIGH COURT-

Court fees payable in Bombay High Court divided in following categories -

1. Court Fees Payable in Civil Cases in Appellate Side of High Court

2. Court Fees Payable in Criminal Cases in Appellate Side of High Court

3. Court Fees Payable in cases in original Side of High Court
