Rules of Practice of the Bombay High Court (HIGH COURT PRACTICE 1)
Practice
before the High Court is governed by rules
framed by the High Court itself. A proper understanding of High
Court practice is not possible without familiarity with these rules, as they
regulate filing, procedure, hearings, and conduct of matters before the Court.
Therefore, knowledge of the High Court Rules is essential for every advocate practicing
before the High Court.
Rules Framed by
the Bombay High Court
The
Bombay High Court has framed the following principal rules governing its
practice and procedure:
(1)
The Bombay High Court (Original Side) Rules, 1980
These
rules govern the practice and procedure of matters instituted on the Original Side
of the High Court. They deal with filing of suits and proceedings,
pleadings, interlocutory applications, hearings, chamber matters, and other
procedural aspects specific to Original Side jurisdiction.
(2)
The Bombay High Court Appellate Side Rules, 1960
These
rules govern the practice and procedure of matters before the Appellate Side
of the High Court, including civil and criminal appeals, writ petitions,
revisions, applications, and other proceedings arising from subordinate courts
and tribunals.
